2.1 Account Information

When you register via Google OAuth, we receive and store:

• Email address
• Google account identifier (for authentication purposes)

2.2 Usage Data

We automatically collect:

• Credit balance and transaction history
• Generation metadata (timestamps, generation type, success/failure status)
• Technical logs for service improvement and troubleshooting

2.3 Payment Information

Payment processing is handled entirely by Stripe. We do not store your credit card details. We only receive:

• Transaction confirmation and amount
• Stripe session identifiers for record-keeping

2.4 Images You Upload

Important: Images you upload for stencil generation are NOT stored on our servers. They are:

• Transmitted directly to the AI processing service
• Processed in real-time to generate your stencil
• Not retained after the generation is complete
• Not used for AI training purposes

3. How We Use Your Data

We process your personal data for the following purposes:

• Service Provision: To authenticate you, manage your account, and provide the stencil generation service
• Transaction Processing: To process credit purchases and maintain transaction records
• Customer Support: To respond to your inquiries and resolve issues (e.g., credit refunds for failed generations)
• Service Improvement: To analyze usage patterns and improve our service
• Legal Compliance: To comply with applicable laws and regulations

5. International Data Transfers

Your account data is stored within the European Union (AWS Ireland).

When you generate a stencil, your image is temporarily transmitted to third-party AI processing servers in the United States. This transfer is necessary to provide the service and is conducted under the following safeguards:

• Images are processed in real-time and not stored
• Our AI provider operates with a zero-data-retention policy for images
• The transfer is based on the necessity for contract performance (GDPR Art. 49(1)(b))

Stripe processes payments in compliance with GDPR using Standard Contractual Clauses (SCCs) for any US data transfers.

6. Data Retention

We retain your personal data as follows:

• Account data: Retained for as long as your account is active
• Transaction logs: Retained for a reasonable period to handle support requests (e.g., credit refunds) and comply with legal obligations
• Uploaded images: Not retained - processed in real-time only

When you delete your account, all your personal data is permanently deleted from our systems.

7. Your Rights (GDPR)

Under the General Data Protection Regulation, you have the following rights:

• Right of Access: Request a copy of your personal data
• Right to Rectification: Request correction of inaccurate data
• Right to Erasure: Request deletion of your data ("right to be forgotten")
• Right to Restriction: Request limitation of processing
• Right to Data Portability: Receive your data in a structured format

8. Account Deletion Request

To request complete deletion of your account and all associated data:

1. Send an email to legal@pexil.it with subject line: "Account Deletion Request"
2. Include the email address associated with your InstaStencil account
3. We will verify your identity by responding to the same email address
4. Upon verification, we will delete all your data within 30 days
5. You will receive a confirmation email once deletion is complete

Note: Account deletion is permanent and cannot be undone. Any remaining credits will be forfeited.

9. Age Requirement

InstaStencil is intended for users aged 16 years or older. We do not knowingly collect personal data from children under 16. If you believe a child under 16 has provided us with personal data, please contact us immediately at legal@pexil.it.

10. Security

We implement appropriate technical and organizational measures to protect your personal data, including:

• Encrypted data transmission (HTTPS/TLS)
• Secure authentication via Google OAuth
• Access controls and authentication for our systems
• Regular security reviews

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by posting a notice on our website or sending you an email. The "Last updated" date at the top indicates when the policy was last revised.

1. Agreement to Terms

By accessing or using InstaStencil ("Service"), operated by Pexil S.r.l.s. ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

InstaStencil is an AI-powered tool that converts images into stencils suitable for tattoo thermal transfer printing. The Service allows users to:

• Upload reference images
• Generate stencil versions using artificial intelligence
• Download generated stencils for personal or professional use

3. Account Registration

To use the Service, you must:

• Be at least 16 years of age
• Register using a valid Google account
• Provide accurate and complete information
• Maintain the security of your account credentials

You are responsible for all activities that occur under your account.

4. Credits and Payments

4.1 Credit System

The Service operates on a credit-based system. Each stencil generation consumes one (1) credit. New users receive complimentary credits upon registration.

4.2 Purchasing Credits

Additional credits can be purchased through our website. All payments are processed securely by Stripe. Prices are displayed in USD and include applicable taxes where required.

4.3 No Expiration

Purchased credits do not expire and remain in your account until used.

4.4 Free Retry System

If you are not satisfied with a generated stencil, you can retry the generation using retry credits:

• Retry allowance: 2 free retries are granted for every 10 credits in each purchased package
• Accumulation: Retry credits accumulate in your account and do not expire
• Usage: Retry credits are consumed when you regenerate a stencil from an already processed image
• New uploads: Retry credits cannot be used for new image uploads - only regular credits are consumed for first-time generations

4.5 Refund Policy

Due to the digital nature of the Service:

• Unused credits: Refunds for unused credit purchases may be requested within 14 days of purchase by contacting legal@pexil.it
• Failed generations: If a generation fails due to a technical error on our side, we will restore the credit to your account upon request
• Used credits: Credits that have been used for successful generations are non-refundable

5. Acceptable Use

You agree NOT to use the Service to:

• Upload images containing illegal content
• Upload images depicting minors in any inappropriate context
• Upload images that infringe on third-party intellectual property rights
• Generate content that promotes violence, hatred, or discrimination
• Attempt to reverse-engineer, hack, or disrupt the Service
• Use automated systems or bots to access the Service
• Resell or redistribute the Service without authorization

Violation of these terms may result in immediate account suspension or termination without refund.

6. Intellectual Property

6.1 Your Content

You retain all rights to the images you upload. By uploading an image, you represent and warrant that:

• You own the image or have the right to use it
• The image does not infringe on any third-party rights
• You have any necessary permissions or releases

6.2 Generated Stencils

Stencils generated by the Service are derivative works of your uploaded images. You may use generated stencils for personal and commercial purposes, including tattoo application. We claim no ownership over your generated stencils.

6.3 Our Content

The InstaStencil name, logo, website design, and underlying technology are owned by Pexil S.r.l.s. and protected by intellectual property laws.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate stencils. You acknowledge that:

• AI results may vary and are not guaranteed to be perfect
• Generated stencils may require manual adjustments
• The AI may occasionally produce unexpected or imperfect results
• You are responsible for reviewing generated stencils before use

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim

These limitations do not affect your statutory rights as a consumer under applicable EU law.

9. Indemnification

You agree to indemnify and hold harmless Pexil S.r.l.s. from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

10. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Use the Service for illegal purposes

You may delete your account at any time by contacting legal@pexil.it. Upon termination, any unused credits will be forfeited.

11. Service Modifications

We reserve the right to:

• Modify or discontinue the Service at any time
• Change pricing for future credit purchases
• Update these Terms with reasonable notice

Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Naples, Italy, without prejudice to your rights as a consumer to bring proceedings in your country of residence under applicable EU consumer protection laws.
